Terms and Conditions
1. Definitions and Scope
1.1 These General Terms and Conditions of Sale (hereinafter the “T&Cs”) govern all contractual relationships between the client and:
The Time Cellar, a trade name operated by Arnaud Dekeyser, a sole trader registered with the Crossroads Bank for Enterprises under number 1023.109.181, whose business address is Avenue des Vallons 16, 1410 Waterloo, Belgium.
In this document, the terms “The Time Cellar”, “we”, “our”, or “the seller” refer to Arnaud Dekeyser operating under his trade name. The terms “you”, “your”, or “the client” refer to any natural or legal person purchasing goods or requesting services from The Time Cellar.
1.2 The term “goods” refers to watches and/or jewelry, as well as any accessories such as boxes, certificates, documents, straps, tools, or any other items directly or indirectly related to the retail trade of watches and jewelry in specialized stores (NACEBEL code 47.770).
1.3 Any order, purchase, or reservation, whether made remotely (internet, social media, telephone) or in person, implies full and unconditional acceptance of these T&Cs. These T&Cs are available upon request and are automatically provided in the event of a sale or transaction.
1.4 The seller reserves the right to modify these T&Cs at any time. The applicable terms are those in force on the date of the order, communicated to the client, and remain valid for the duration necessary to fulfill said order.
1.5 Products are described as accurately as possible. However, photographs are not contractually binding. The Time Cellar cannot be held responsible for errors or omissions, nor for any differences in perception.
2. Prices
Prices are expressed in euros and include all taxes (VAT included), excluding processing and shipping costs. Prices may change without prior notice but remain those applicable at the time of order confirmation. No retroactive adjustment will be applied.
3. Availability
Our product and pricing offers are valid as long as they are communicated directly to the client, subject to availability.
In the event of unavailability after order confirmation, The Time Cellar undertakes to inform the client as soon as possible, by email or any other provided contact method.
In such case, the order will be canceled and, if payment has already been made, the full amount will be refunded within a reasonable time, at no additional cost to the client.
4. Payment
Payment is made by SEPA bank transfer or in cash within the legal limits applicable in Belgium (€3,000).
No product will be shipped or delivered before full payment of the total amount due.
If The Time Cellar has reasonable grounds to suspect fraud, regardless of the payment method used, the transaction may be suspended. No delivery or refund will be made until verification by the competent authorities has been completed.
5. Orders and Reservations
5.1 Orders may be placed via direct exchanges (appointments, events), online platforms (social media, marketplaces or, where applicable, the website), messaging or email.
5.2 An order is validated after written confirmation (message, email, pro forma invoice) and receipt of full or partial payment.
5.3 A watch may be reserved for a maximum period of 1 month upon payment of a deposit ranging from 10% to 20% of the total price. This deposit qualifies as earnest money: in case of withdrawal, it will not be refunded, unless expressly agreed otherwise in writing.
5.4 In case of non-payment of the remaining balance by the agreed deadline, we reserve the right to retain the deposit and put the product back on sale without further compensation.
6. Delivery
6.1 Methods of delivery:
The Time Cellar offers two delivery methods:
Secure shipping via carriers such as DHL, FedEx, Ferrari, UPS, or postal services (international registered mail), according to the client’s choice.
In-person collection by appointment only, provided that the full amount has been paid in advance.
The delivery method is agreed upon at the time of the order. Delivery is considered completed when the goods are delivered to the client at the specified delivery address, or collected by the client directly from The Time Cellar.
6.2 Processing times:
Once the order is confirmed and payment validated, The Time Cellar undertakes to prepare the shipment within 1 to 3 business days.
This timeframe may vary depending on the delivery location and logistics availability. Delays attributable to the carrier shall not give rise to compensation.
6.3 Shipping costs and risk coverage:
Shipping costs are communicated by email prior to dispatch and vary depending on the carrier, destination, and level of insurance selected.
The risk related to transport is transferred to the client once the parcel is handed over to the carrier.
The Time Cellar ensures careful preparation of each shipment but cannot be held responsible for delays, loss, or damage during transport, unless specific insurance has been taken out prior to shipment.
6.4 Taxes, customs, and destination charges:
The client is solely responsible for the payment of any local taxes, customs duties, or additional charges related to the receipt of goods in their country.
The Time Cellar disclaims any responsibility for such obligations.
6.5 Receipt and inspection:
Upon receipt, the client or any designated third party must immediately inspect the goods.
In case of missing, damaged, or altered parcels, the client must make clear reservations with the carrier and notify the seller within 24 hours of receipt, with supporting evidence (photos and/or videos).
Any damaged parcel must be refused and not signed for.
7. Returns & Complaints
Any complaint must be addressed by email to info@thetimecellar.com or via the contact form if available.
7.1 Right of withdrawal (distance sales only):
The client has a 14-calendar-day withdrawal right from receipt of the product, in accordance with the Belgian Code of Economic Law.
7.2 Returns are at the client’s expense and must include the unworn product, all accessories, documents, protections, packaging, without any signs of use or excessive handling.
7.3 In case of depreciation, The Time Cellar reserves the right to apply a reduction of up to 30% of the refunded amount.
7.4 Refunds will be processed within 14 days following receipt and inspection of the returned item.
7.5 This right does not apply to in-person sales.
7.6 Upon receipt, the client must immediately inspect the goods. Any non-conformity, visible defect, or damage must be reported without delay, preferably in writing and supported by evidence (photos or videos).
7.7 Notification and return conditions:
Without prejudice to transport risk provisions, any claim regarding damaged or non-conforming goods must be made within 14 calendar days of delivery.
The client must return the product concerned, all associated accessories (box, links, certificate, manual, service documents, etc.), in the exact condition in which it was delivered.
Failure to comply with this deadline or to return a complete set will result in the goods being deemed compliant and accepted without reservation.
7.8 Handling defective products:
After inspection and subject to compliance with the above conditions, The Time Cellar will, at its discretion, replace the product, repair it, or provide a partial or full refund.
The chosen solution will depend on the nature of the defect and product availability.
7.9 Costs borne by the client:
Unless otherwise agreed, return shipping, packaging, insurance, and reshipping costs are borne by the client, including any applicable taxes or import duties.
8. Warranty
8.1 All pre-owned watches are covered by a 12-month warranty against mechanical defects or hidden defects, unless stated otherwise.
8.2 The warranty excludes normal wear and tear (straps, glass, crowns, etc.), damage caused by improper use, water, shocks, magnetic fields, and interventions by unauthorized third parties.
8.3 In case of a claim, the client must provide the original invoice and return the product for inspection. The Time Cellar may then repair, replace, or partially or fully refund the product.
9. Intellectual Property
All content published by The Time Cellar, including texts, visuals, descriptions, photographs, layouts, product sheets, and graphic elements, is protected by copyright and, more generally, by intellectual property laws.
Any reproduction, modification, distribution, transmission, or exploitation of such content, in any form, is strictly prohibited without prior written authorization from The Time Cellar.
The website may also contain elements protected by third-party intellectual property rights (for example trademarks, visuals, or descriptive content provided by partners or manufacturers). No license or authorization is granted for their use.
10. Applicable Law and Jurisdiction
In the event of a dispute, the seller undertakes to seek an amicable solution prior to any legal proceedings.
These T&Cs are governed by Belgian law. In case of dispute, the courts of the judicial district where the business is located, namely Brabant Wallon, shall have exclusive jurisdiction, unless an amicable settlement is reached beforehand.
